DUI Report: West Boca
Five DUI incidents for West Boca residents caught our attention. A Palmetto Pines couple collaborated in one episode, while individual men from Century Village, Meadow Lakes Estates and Loggers’ Run had their own moments.
John Tuoto (right, 54, Palmetto Pines) was arrested on the strip in East Delray after witnesses saw his motorcycle fall to the ground. They assisted Tuoto in getting his bike off the road.
Delray PD responded and arrested Tuoto for DUI. He registered roughly 0.19 on breath testing but they had to test him 3 times to get a consistent result, which could work in his favor.
A better argument in his defense is that the officers apparently did not see him driving and it doesn’t appear that he admitted to driving (or that they even asked him). It’s unclear if the prosecution can get witnesses to establish that critical issue in the case.
After he was arrested his passenger (and possibly wife or girlfriend) She yelled at police that they were doing this “because of William Floyd, or whatever his name is.” Then she walked over to some people sitting outside at a restaurant, leaned into their table yelling “I’m not social distancing” and was then arrested for disorderly intoxication.
We don’t see any priors for either of them. Joann’s case has already been dismissed through a pre-trial diversion program.
Scott Cohen (52, Wolverton, Century Village) was arrested after rear-ending another vehicle on Lyons Road around 9 pm one evening. A witness observed Cohen in the driver’s seat, but Cohen was in the back seat when the deputy arrived. This could create a similar proof problem to the Tuoto case above.
Cohen tested negative for alcohol on a breath test at the station but admitted to having smoked marijuana and having eaten a “brandy cake”. He also agreed to provide a urine sample, but court records so far do not show the results of that.
This is a case where the driver might not only win but actually be innocent.
We see no priors for Mr. Cohen.
Chol Yoo (48, Meadow Lakes Estates) allegedly crashed a white Mercedes SUV on SW 18th near the new Enclave townhome development and Boca Barwood.
The police report describes Yoo as a restaurant manager but we also see a real estate license for him connected to a Miami real estate broker.
Yoo registered 0.14 on breath testing.
We see no priors for him.
Robert Nichols (31, Cimarron, Loggers’ Run) was arrested for DUI in East Boca. The police reports indicates he is a server at Grand Lux Cafe.
Boca PD stopped him for running a red light along with speeding and failing to maintain his lane.
He registered 0.13 on breath testing.
Court records indicate a previous DUI in 2012.
